Many questioned why the San Francisco 49ers did not suspend linebacker Aldon Smith after he reportedly crashed his car Friday morning, allegedly while drunk.

It would be the second DUI for Smith in two years, a clear problem for the young man.

Well – the reason for the lack of action from the 49ers is pretty clear – they couldn’t suspend him.

According to ESPN’s Chris Mortensen, the 49ers had their hands tied in regards to a suspension (not to say they would have done so anyway) under the new collective bargaining agreement.

The 49ers plan to get Smith help after the weekend as well:

"Aldon Smith could not be suspended by 49ers under CBA; consensus is get Smith to treatment once they get thru weekend. Help the young man."

Contrary to initial reports, while unspecified pills were found in Smith’s car, there was no marijuana as initially suggested.

Whatever the case, it’s clear Smith has some type of problem, especially with alcohol and hopefully the 49ers can help the talented though troubled defender fight through his demons.
