The San Francisco 49ers were hoping to have linebacker Aldon Smith return to the team after their bye this weekend, though before he does the Pro Bowl talent turned himself into authorities on felony weapons charges, this according to NBA Bay Area:

"San Francisco 49ers linebacker Aldon Smith surrendered to authorities Tuesday night and then almost immediately posted bail, according to a source close to the case.Smith is now scheduled to appear in court to face felony weapons charges on Nov. 12 and on Nov. 19 to face misdemeanor DUI and drug charges."

Smith, after crashing his car in an unrelated incident had been in substance abuse rehab for the past few weeks, but is now apparently out. NBC Bay Area reports that Smith immediately posted $75,000 dollars bail and was sent on his way.

The NFL has yet to determine if they will suspend Smith when he is reinstated by the team for the alleged drunk driving charge, though, will likely wait for the legal process to take place before making any final decision.
