It was reported that Florida State quarterback Jameis Winston would appear at a code of conduct hearing involving two teammates on Tuesday, but the Heisman Trophy winner did not show up, according to a report from USA Today.

The hearing was involving the incident that had Winston mired in controversy last season when a woman accused him of a sexual assault, and there was speculation as to whether or not Winston would once again decline to comment on situation.

Winston’s teammates Chris Casher and Ronald Darby were charged with five violations of the FSU student code of conduct related to the Dec. 7, 2012, sexual encounter between Winston and the woman.

The woman’s attorney, John Clune, released the following statement:

"“As reported, a hearing was held at Florida State today for the two students charged in connection with the investigation of Mr. Winston. Out of respect for the confidentiality of the school’s process, we will not comment on what transpired in the hearing room. We do confirm that our client was present as were the two charged students. Although we were told by the school that Mr. Winston would be called as a witness, he did not show for the hearing and no further explanation was given. Under the student code of conduct, the school has 10 days to reach a decision.”"

In what was an odd twist to this case, Winston was not charged with any violations of the school code because of his unwillingness to comment and cooperate with the criminal proceedings, leaving school officials with insufficient evidence to charge Winston.
