Aldon Smith Was Drinking During Assault Incident Per Report

San Francisco 49ers linebacker Aldon Smith might be in a new round of trouble as details emerge from the Ray McDonald case that he was drinking during the incident.

The 49ers recently dealt with defensive tackle Ray McDonald, now embroiled in another round of assault allegations, by releasing him. But, they might have yet another problem with troubled linebacker Aldon Smith.

According to a story by Pro Football Talk, the affidavit detailing the assault allegations and circumstances against McDonald, named Aldon Smith as present with McDonald and drinking.

Specifically, the victim reports that she spent the day drinking with Smith and McDonald.

That’s a big problem if true, because Smith is still on probation for his 2013 DUI.

According to Mike Rosenberg of the San Jose Mercury Time, the timeline went as follows:

The police have seized McDonald’s home surveillance video as well as his cell phone records to assist in their investigation.

The Niners previously dragged their feet on McDonald, waiting for something substantial to emerge from the first allegation of domestic assault. They stood by him in the face of harsh criticism even as the Adrian Peterson and Ray Rice situations were going on. Then, the rape case broke after their loss to the Seattle Seahawks and elimination from the playoffs. That’s when they released McDonald. Whether it was because their season was effectively over or because two strikes was enough, is hard to say.

Now they have the unfortunate position of having to once again defend Aldon Smith, who seems to have found himself yet another spot of trouble.
