CNN is reporting that surveillance video used to charge Robert Kraft with soliciting prostitution has been leaked and may be up for sale.

Lawyers representing the two women accused of running the spa where Robert Kraft and other allegedly solicited prostitutes have filed a motion, asking a judge to prevent a leak of video evidence that may show Kraft engaged in illegal acts.

CNN is reporting, “Attorneys cited a report published Thursday on a celebrity news website that claimed it was ‘recently contacted by a party who claimed to have obtained portions’ of the video.” Since law enforcement and prosecutors would be the only ones in possession of this video evidence, the implication is that someone on their side has leaked it, in violation of a temporary protective order a judge in the case had already put into place on Wednesday.

Kraft has apologized for his actions but also declined to accept a plea deal from prosecutors that would have topped out with fines and community service but required him to admit that he would be found guilty if this matter went to trial. Instead, the Patriots owner has pled not guilty and moved ahead with plans to pursue a jury trial.

CNN’s report also notes that the Palm Beach County State Attorney’s Office had previously said they planned to release the tape, showing Kraft and 24 other men who were caught up in the sting operation. it was Kraft’s lawyers who sought the initial order preventing the release of the tape, worried that it could taint a jury pool and damage his ability to get a fair trial.  The story has taken one sordid turn after another and having the tape released would only bring more attention to a story Kraft and the Patriots would clearly like to put behind them as quickly as possible.
