Busch had previously been accused of physically assaulting then girlfriend, Patricia Driscoll. On Monday, Driscoll was issued an order of protection by a Delaware Family Court.
Kent County Commissioner David Jones was able to determine after examining the evidence that Busch grabbed Driscoll by the throat and “manually strangling her,” while taking his other hand and smashing her head against a wall.
The incident was alleged to happen back in September, in the motor home belonging to Busch after the race at Dover.
Busch will not be driving this Sunday, instead Regan Smith will be driving his car as the NASCAR season kicks off in Daytona.

A criminal investigation is still ongoing and it has yet to be determined whether criminal charges will be filed against Busch.
NASCAR, following suit with the NBA, NHL and NFL is the latest to start coming down swiftly, taking domestic abuse cases seriously and allowing the court process to play out before allowing players/racers to return.
The green flag will drop on the new season Sunday, but Busch will not be one of the drivers out there.
