Police: 49ers’ Aldon Smith appeared to have been drinking earlier in the day

San Francisco 49ers defensive end Aldon Smith has been arrested for false report of a bomb threat at LAX airport on Sunday. According to LAX police, it appears Smith had been drinking earlier in the day though not he was not intoxicated at time of his arrest.
“He was not what we considered to be intoxicated,” LAX Police Sgt. Karla Ortiz told CSNBayArea.com, “but he appeared as if he had been drinking earlier in the day.”
Smith won’t be given a blood-alcohol test because it wasn’t why he was arrested. Smith has had a history of issues involving alcohol including a DUI arrest that led to him seeking treatment.
“We are disappointed to learn of the incident today involving Aldon Smith,” the 49ers said in a statement. “As this is a pending legal matter and we are still gathering the pertinent facts, we will have no further comment.”
