One of the Baylor Title IX lawsuits levied has been settled out of court

The rising cost of Title IX lawsuits brought by several individuals against Baylor went up a little more on Tuesday, as the school reached settlement in one of the cases.

While there are still several more Baylor Title IX lawsuits outstanding, the settlement of one of them on Tuesday out of court represents a little savings and a step toward finality in the legal proceedings for the embattled member of the Big 12 conference.

According to Paula Lavigne of ESPN, this case had some unique elements to it which made it easier for Baylor to reach settlement with the plaintiff on. The plaintiff was not a female former student, as is the case in most of the rest of the lawsuits, but a former member of the school’s financial aid department.

Lyn Wheeler Kinyon sued Baylor after she was fired from her job as a financial aid officer, claiming she was discriminated against because she reinstated the scholarship of Jeremy Faulk. Faulk was a member of the Bears’ football team who had been accused of sexual assault and dismissed from the team.

Kinyon played a part in reinstating Faulk’s scholarship after he was dismissed from the team and had his scholarship revoked without an investigation into the alleged sexual assault being completed. Kinyon believed Faulk was innocent, and Faulk maintained his innocence as well. Faulk appealed the revoking of his scholarship, which he won partially because of Kinyon’s vote. Baylor dropped the allegations against him and Faulk later transferred. Kinyon was terminated two months later.

Kinyon’s case rested on a clause of Title IX which makes illegal any retaliation upon individuals who allege violations of Title IX. She alleged that Baylor had discriminated against Faulk because of his gender in her Title IX complaint. Through this case, Baylor stood accused of gender discrimination against both male and female students.

The amount of the settlement has not been disclosed, but as previously stated, there are still several other Title IX suits against Baylor in progress. The total sum of legal proceedings, and the total cost, are far from settled.
